The notaries of the 21st century are professionals at the cutting edge of innovation, at the service of consumers. The Notariat provides citizens, companies and institutions with advanced and technologically innovative instruments of the utmost security and trust. The electronic services currently provided to society by notaries guarantee impartiality, oversight of lawfulness and consultancy, the historic foundations of the prestige of the Notariat.

The technological investment begun by the Notariat in the year 2000 has provided the notarial body with the most advanced resources and information systems for the exchange and electronic processing of documents and data with public authorities (Autonomous Regions, Directorate-General for the Land Survey, Companies and Land Registers, Tax Agency, local councils, Register of Last Wills, etc.) and with private entities.

Notaries: trusted professionals

The globalisation of the Information Society opens up almost limitless possibilities for the exchange of knowledge, business and social welfare, but is not perfect. The Internet, and Information and Communication Technologies (ICT), are areas with many unknown aspects representing a lack of security for the public, with interlocutors whose reliability is not proven, or who lack the impartiality required in order to establish themselves as trusted third parties. For citizens, notaries, as civil servants collaborating in legal and professional compliance with the utmost competence, have always been a byword for security and trust. Impartiality, oversight of legality and consultancy have always been the foundations of the high level of prestige maintained over centuries. While painstakingly preserving these qualities, notaries have now added the cutting-edge use of new technologies. As a secure gateway to the world of new technologies, offering greater efficacy and speed in services, the Notariat of the 21st century is a response to the public demand to maintain security and the protection of individual rights and social coexistence.

Notaries and the "trusted third party"

Information Society and Electronic Commerce Services Act 34/2002, of 11 July 2002, states in Article 25: "The parties may agree that a third party should archive the declarations of will comprising electronic contracts and record the date and time when said communications place". It is added that "The involvement of such third parties may not alter or substitute the functions to be performed by those persons legally empowered to bear public witness".

Hence the fact that the "trusted third party" is based on a prior relationship between two parties with contrary interests, and there must be an agreement between them to archive and preserve communications in electronic format.

The Act expressly states that this "third party" may not alter or substitute the functions of the public witness.

This is therefore the natural or legal person that, following an agreement by the parties in an electronic transaction, is entrusted with the computerised file containing it. This document has the value of a private document.

Can a notary be a trusted third party?

This is a fairly widespread belief, perhaps because notaries archive documents. But unlike the "trusted third party", who simply archives and preserves, the notary provides a function of impartial consultancy prior to execution of the contract, draws up the text, oversees its legality, verifies the capacity of the contracting parties and authorises the document, that he then also archives, guaranteeing its perpetual preservation.

The document thus drawn up is a public instrument which receives particular support within the legal system, with specific effects that are much more powerful than those vested in a private document.

A notary is therefore not such a trusted third party, although he may use certification service providers to perform certain actions, in particular acts of deposit of computer files, as expressly governed by the Notarial Regulation since the year 2007.

In this task, the Notarial Certification Agency, ANCERT, is positioned as the technological branch at the service of the notarial body.

The future is already present at notarial offices. For centuries now, in any contract and in relationships with the public authorities and financial institutions, notaries have provided security. Now, in the 21st century, through intense investment for the application of new information and communication technologies, notaries provide speed, convenience and cost-effectiveness, with the same level of security.

María Teresa Revilla recibe el II Premio Consuelo Mendizábal de Fundación Notariado

María Teresa Revilla López, única diputada integrante de la Comisión Constitucional encargada de redactar la Constitución Española de 1978, ha recibido hoy el Premio Consuelo Mendizábal en su segunda edición, otorgado por la Comisión ‘Notariado, Mujer y Sociedad’ de Fundación Notariado. El galardón, que toma el nombre de Consuelo Mendizábal, la primera mujer notaria, tiene como objeto reconocer la labor de quienes han vivido y trabajado para conseguir una sociedad igualitaria en todos los ámbitos de la vida y para todas las personas, con especial énfasis en los derechos y oportunidades de las mujeres.

Durante el acto, celebrado en la sede del Consejo General del Notariado, se puso en valor la trayectoria de Revilla y su compromiso con la defensa de la igualdad entre hombres y mujeres en el proceso constituyente. En una Comisión Constitucional formada únicamente por diputados varones, María Teresa Revilla solicitó expresamente en 1977 formar parte de dicha Comisión. Al mismo tiempo, ya durante la votación del artículo 14 de la Constitución, que consagraba dicha igualdad, hizo oír su voz subrayando la importancia de que las mujeres alcanzaran la plenitud de derechos en el nuevo marco democrático.

La presidenta del Consejo General del Notariado y de Fundación Notariado, Concepción Pilar Barrio Del Olmo, destacó durante su intervención que “Consuelo Mendizábal y las primeras mujeres notarias fueron auténticas precursoras que abrieron camino en una profesión en la que, durante mucho tiempo, la presencia femenina fue excepcional. Hoy su ejemplo sigue siendo un referente y nos recuerda la importancia de seguir trabajando por una sociedad más igualitaria”.

Barrio Del Olmo quiso subrayar también el papel que jugó Revilla al solicitar formar parte de la Comisión Constitucional, siendo la única mujer en hacerlo: “En una época en la que las mujeres no tenían plena capacidad de obrar, María Teresa quiso alzar la voz en un momento decisivo para nuestra democracia. Por todo ello y por ser un referente, la Comisión ‘Notariado, Mujer y Sociedad’ votó unánimemente para darte este Premio”.

Por su parte, la premiada, María Teresa Revilla, recordó su experiencia en los trabajos constituyentes y el contexto histórico en el que se elaboró la Constitución de 1978, señalando que “yo luché por traer la democracia a España. Pero la democracia no es algo que se pueda dar por hecho: hay que cuidarla, protegerla y trabajar cada día para fortalecer nuestras instituciones”.

Asimismo, evocó con humor algunos episodios de su trayectoria parlamentaria y recordó cómo finalizó su etapa política tras un incidente cuando presidía la Comisión de Cultura del Congreso. “Un día un ministro comenzó a intervenir sin que yo le hubiera dado la palabra y tuve que decirle que se callara. Aquello causó bastante revuelo y después de eso mi carrera política prácticamente terminó”, relató.

Finalmente, el director general de Fundación Notariado, Raimundo Fortuñy Marqués, subrayó igualmente el significado de este reconocimiento y el valor de la figura de Revilla en la historia democrática reciente, afirmando que “María Teresa Revilla vio lo que todos habían visto —que la Comisión Constitucional estaba formada solo por hombres—, pero pensó lo que nadie había pensado y decidió actuar para que también hubiera una mujer. Ese gesto de audacia sigue teniendo hoy un profundo significado, porque la igualdad ante la ley constituye uno de los pilares de nuestras democracias y también uno de los valores que inspiran el Premio Consuelo Mendizábal”.

El trofeo

El galardón es una escultura de la artista madrileña Cristina Almodóvar (1970), cuya obra explora la relación entre el ser humano y la naturaleza desde un lenguaje escultórico cercano a la poesía. Para este Premio ha creado una pieza inspirada en los pliegos de las escrituras notariales, que se elevan y se transforman en formas orgánicas. La obra simboliza cómo la labor notarial, al ordenar jurídicamente la realidad, genera una sensación de claridad y liberación tras la formalización de los actos y decisiones de la vida civil.

Consuelo Mendizábal, primera mujer en el Notariado moderno

María Consuelo Mendizábal Álvarez, natural de Oviedo, fue también la primera mujer asturiana en licenciarse en Derecho en 1931.

En 1942 fue la única mujer que concurrió a las oposiciones a notario entre 1.100 aspirantes y una de las 205 personas que las aprobaron. Su primer destino fue Portillo, pueblo de Valladolid. A ella se sumarían posteriormente Margarita Baudín, que aprobó en 1944, y Carolina Bono, en 1947, configurando así las tres primeras mujeres notarias en la década de los cuarenta. Hasta 1961 no se permitió a las mujeres participar nuevamente en oposiciones a la Administración Pública.

Consuelo Mendizábal se jubiló como notaria en Madrid en 1983, y falleció en 1992. Su figura constituye un hito en la historia del Notariado español y simboliza el esfuerzo y la capacidad de las primeras mujeres que abrieron camino en el ámbito jurídico, y a pesar de no tener plena capacidad de obrar reconocida hasta la reforma del Código Civil español en mayo de 1975.

La mujer en el Notariado actual

La presencia de la mujer en el Notariado se reanuda tras la mencionada ley de 1961. El acceso a la profesión fue tardío, y fue consolidándose tras la eliminación de la licencia marital en 1975 y avanzando progresivamente desde 1990. En la actualidad, 977 mujeres ejercen la función notarial en un colectivo de 2.788 notarios. En sintonía con otras profesiones, los resultados de las oposiciones en las últimas décadas reflejan un crecimiento sostenido de la presencia femenina en el Notariado, superando el 50% en las promociones más recientes.
